Terms of service

Terms of Service

These Terms of Service apply to services provided by Grounded Property Group (“Grounded”, “we”, “us” or “our”). By booking, purchasing or engaging Grounded Property Group to provide services, you agree to these terms.

1. Our Services

Grounded Property Group provides professional turf consultation, turf management and property presentation services.

The scope, frequency and inclusions of services will depend on the consultation, program, quotation or service agreement selected by the client.

Recommendations and services may be adjusted over time in response to seasonal conditions, turf performance, weather, pest or disease pressure and other site-specific factors.

2. Consultations

Where a consultation is required, the consultation fee is payable in full at the time of booking unless otherwise agreed by Grounded Property Group.

A consultation may include discussion of the property's history and the client's objectives, visual assessment of the turf and site, measurements, irrigation observations and identification of apparent turf, weed, pest, disease, soil or drainage issues.

Recommendations are based on conditions reasonably observable at the time of inspection. A consultation does not constitute an engineering, structural, laboratory, plumbing or other specialist inspection unless expressly stated.

Consultation Credit

Where a client proceeds with an eligible ongoing Grounded Property Group turf management program within 30 days of their consultation, the consultation fee will be credited in full toward the client's first program invoice.

The consultation credit is limited to one consultation fee per property, applies only to eligible ongoing Grounded Property Group programs, does not apply to one-off services unless otherwise agreed, must be used within 30 days of the consultation, and is not transferable or redeemable for cash.

The consultation remains a standalone professional service. Clients who choose not to proceed with an ongoing program will still receive the assessment and recommendations included with their consultation. The consultation fee will not be refundable solely because the client chooses not to proceed with further services.

3. Bookings and Payment

Prices and payment arrangements will be communicated before services commence.

Consultation fees are payable at the time of booking. Ongoing programs and other services will be charged according to the applicable quotation, program or service agreement.

Additional work outside the agreed scope may incur additional charges. Grounded Property Group will obtain the client's approval before undertaking material additional work that will result in additional charges.

Unless otherwise stated, prices displayed on our website, quotations or service agreements are in Australian dollars.

4. Property Access

The client is responsible for providing safe and reasonable access to the areas required for Grounded Property Group to perform the agreed services.

Gates should be accessible, pets appropriately secured and work areas reasonably clear of obstacles where necessary.

The client should advise us of any known hazards, access restrictions, underground services, irrigation infrastructure or other conditions that may reasonably affect the safe provision of our services.

If we cannot safely or reasonably access the property at the scheduled time, the visit may need to be postponed or treated as a missed visit depending on the circumstances.

5. Client Responsibilities

Successful turf management requires cooperation between Grounded Property Group and the client.

Where applicable, clients are responsible for following reasonable care instructions provided by Grounded, including watering, irrigation operation, mowing practices, access restrictions and post-treatment requirements.

Where irrigation or other property systems are controlled by the client, the client is responsible for ensuring those systems are operated as reasonably instructed.

Grounded Property Group is not responsible for deterioration or reduced results caused by matters outside our reasonable control, including failure to follow reasonable care or maintenance instructions.

6. Turf Treatments

Where included in the agreed service, Grounded Property Group may apply fertilisers, soil amendments, wetting agents, plant growth regulators, herbicides, insecticides, fungicides or other turf-management products.

Products will be selected and applied according to the circumstances of the property, applicable product directions and relevant legal requirements.

Clients must advise Grounded before treatment of any relevant property conditions, access restrictions or other information reasonably necessary for the safe provision of the service.

Any specific irrigation, re-entry or aftercare instructions provided following an application should be followed.

7. Turf Results

Turf is a living system and its condition is influenced by many factors outside the direct control of Grounded Property Group.

These may include weather, temperature, rainfall, sunlight, shade, soil conditions, drainage, irrigation, turf variety, previous management, mowing practices, pests, disease and client maintenance.

Grounded Property Group will provide its services with due care and skill. However, we do not guarantee a particular aesthetic or biological outcome within a particular period unless that outcome has been expressly agreed in writing.

Some properties may require corrective work, turf renovation, irrigation improvements, soil amendments or additional treatments beyond a standard program to achieve the client's desired result.

8. Existing Conditions

Grounded Property Group is not responsible for pre-existing defects or conditions at a property, including inadequate drainage, irrigation faults, poor soil preparation, unsuitable turf selection, soil compaction, hidden infrastructure, previous chemical damage or existing pest and disease issues.

Where such issues become apparent, we may recommend additional investigation, specialist advice or corrective work.

Any additional work will be discussed with the client before proceeding where it will result in additional charges.

9. Weather and Scheduling

Turf management and property services are weather-dependent.

Rain, excessive heat, unsuitable ground conditions, chemical application requirements, safety considerations or other circumstances may require a scheduled visit to be changed.

Where Grounded Property Group postpones a service for weather, operational, safety or agronomic reasons, we will arrange the service for another suitable time.

A reasonable weather-related or agronomic schedule change does not constitute a failure to provide the service.

10. Ongoing Programs

Grounded Property Group's ongoing programs are designed around proactive, seasonal management rather than isolated individual treatments.

Individual visits form part of a broader property and turf-management plan.

The exact work undertaken during individual visits may therefore vary according to turf condition, season, weather, growth, pest or disease pressure and the requirements of the property.

Where a program specifies an annual number of visits, scheduling may vary throughout the year due to weather, seasonal requirements, public holidays, property conditions and sound turf-management practices.

A stated annual number of visits should not be interpreted as guaranteeing that visits will occur at identical intervals throughout the year unless expressly agreed otherwise.

Any applicable minimum term, payment frequency, inclusions, exclusions and cancellation arrangements will be disclosed in the relevant program, quotation or service agreement.

11. Additional and One-Off Work

Work outside the inclusions of an ongoing program may be quoted separately.

This may include substantial turf renovations, topdressing, irrigation installation or repairs, turf replacement, specialist pest or disease treatments, major soil remediation, putting green works, landscaping or other property improvements.

Grounded Property Group will obtain approval before undertaking additional chargeable work that materially exceeds the agreed scope.

12. Cancellations, Rescheduling and Refunds

Consultation cancellations, rescheduling and refunds are governed by our Return and Refund Policy.

Additional cancellation conditions applying to ongoing programs or other services may be specified in the applicable quotation, program or service agreement.

Grounded Property Group may reschedule services where reasonably necessary because of weather, site conditions, safety considerations or circumstances outside our reasonable control.

13. Photographs and Property Records

Grounded Property Group may take photographs, measurements or other records where reasonably required to document property condition, treatment progress, recommendations or work performed.

These records may form part of the client's property history and ongoing management records.

Identifiable photographs or video of a client's property will not be used for advertising, social media or other promotional purposes without the client's permission.

14. Liability

Grounded Property Group will provide its services with due care and skill.

To the extent permitted by law, Grounded Property Group is not responsible for loss, damage or deterioration caused by circumstances outside our reasonable control, pre-existing property conditions or a client's failure to follow reasonable instructions provided in connection with our services.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law.

15. Changes to Services, Programs and Pricing

Grounded Property Group may update its services, programs, inclusions and pricing from time to time.

Changes will not retrospectively alter services already purchased except where agreed with the client or required by law.

Where changes materially affect an ongoing client arrangement, Grounded Property Group will provide reasonable notice where appropriate.

16. Website Information

Information provided on the Grounded Property Group website is intended as general information about our services and approach.

Turf-management information published on the website is general in nature and may not be appropriate for every property.

Site-specific recommendations should be based on the individual property's conditions and, where appropriate, a Grounded Property Group consultation.

17. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law where those guarantees apply.

Nothing in these Terms is intended to exclude, restrict or modify rights or remedies available to consumers that cannot lawfully be excluded, restricted or modified.

18. Governing Law

These Terms are governed by the laws of Queensland, Australia.
